It was the Airdrie programme on remembrance weekend that showed the German soldiers on the train.

Pretty sure it was about it being a Czech Republic flag with Veiss on it rather than a Slovakian one

copyright law isnt my strong point but unless ff has very small print, the original owner ie the person taking the photo retains all copyright. when you take a photo you automatically have copyright, you dont need to claim it.

public domain doesnt mean anything, just that its out there. it doesnt mean anyone can reuse it without crediting the original source.

Sorry too late ,you will have to contact both the sun and the record tell them you own the copywrite to the picture they will ask for proof you can email them the original and they will send you a cheque.

Porter, just send them proof it's your picture along with an invoice for a realistic amount and you should have no problem getting cash for it. I'd say 100-150 is reasonable.

Ive no idea if the guys who made the flag did this deliberately or not, however that was the czecheslovakian flag so technically they arent wrong.

The person who took the photpgraph has image rights to the photograph and this cannot be published without permission. He should get onto the papers and lodge a claim if he can prove it.
Ask Tommy Sheridan for advice as he has gone after other News International publications on the odd occasion so we are led to believe.

Here is a tip, always start the first letter politely, if you end up suing them, this letter will be shown at Court and you don't want to come across aggressive from the get go. You want to be seen as the victim and be hard done by so the Court will compensate you, so you want to start out polite but state what you want at the same time.

I'd send them something like this, send it by post, stuff email. Mark it urgent, or it could end up in the pile of post in the mail room for weeks.

Freelancer's Question: I am a photographer for a student newspaper and take pictures of various university sports matches. I've just found out from a friend at another university that one of my images has been included on a flyer sent to all students of this university by the union. They have not asked my
permission and it's quite annoying. I've been told to send them a bill, but I'm not sure how to go about this. Do I explain it all in a covering letter and
how do I spell out the legal issues/implications, assuming I have to?

Expert's Answer: As a photographer, you, or possibly the student newspaper depending on the agreement between you, will own the 'copyright' in the photographs you took.

By owning the copyright, others cannot legally copy or use the images without your permission. If they do so, this is known as 'infringement of copyright'.
It appears from what you say that the other university has infringed your copyright. You will be entitled to demand that they don't use your image again and destroy any flyers still in their possession.
You will also be entitled to compensation. This can be calculated either by the financial loss you have suffered by them using your image, or by the financial gain they have enjoyed from using your image, or a reasonable royalty for their use of your image. In situations like this, it is usually difficult to ascertain your financial loss or their gain so most people will demand a royalty.

Basically, you should consider what you would have charged them to use your image on their flyers had they asked your permission. You will be entitled to claim this.

Strictly speaking, this is not a matter of invoicing, but of claiming damages and so you should simply write to them explaining that you are the photographer and therefore own the copyright of this image, and that you have not given them permission to use it.

You should state that you are claiming a reasonable royalty for their use of these images based on what you would have charged them had they asked for your permission, and demand that they pay you this sum within, say, 7 days. If they do not pay, you have the right to take them to court and ask for orders that they don't use your image again, destroy any flyers still in their possession and pay you damages on top of this.

Copyright is a given, the person who took the photo owns that right. If anyone reproduces it they are infringing copyright unless they have the owners permission.

As bkk stated, after the signing of the Berne Convention an item is copyright protected upon creation. Publishing it on the internet does not mean one gives up their copyright protections or that it becomes "public domain", public domain is the term for anything that is no longer covered by copyright (be it the copyright was abandoned, the term expired, etc).
